Title - Railways must pay Compensation, If passenger dies getting on or off Train

Railway cannot deny claims citing negligence in case of injury or death while boarding and de-boarding train. In any such case railway is liable to pay compensation to passengers.

Justice R F Nariman and A K Goel held that any ‘untoward incident’ entitles victim for compensation.

However, different high courts differ in their judgement earlier by ruling judgement in favour of railways but all controversy is now to put to an end by the apex court.
