: A single bench of Justice Ashwini Kumar Singh on Friday rejected a writ petition of owner of a JCB machine vehicle, Vishwambhar Singh, who had sought compensation of Rs 4.72 lakh from East Central Railway (ECR) for continuing seizure of JCB machine vehicle for 59 days even as he had deposited the fine for wrong parking on railway land in West Champaran. Justice Singh held that the genuineness of the petitioner's claim has to be decided by the court of railway magistrate, West Champaran. The counsel of the ECR submitted that the petitioner had himself sought time from the ECR for re-registration of his JCB vehicle as the time of its registration had lapsed. Petitioner's counsel submitted that the JCB vehicle, which is used for cleaning and removing encroachments, was the source of his livelihood. Hence, its continued seizure was illegal and affected him. |
